本政策以中文、英文兩種語言編寫，如出現中英歧義，則以中文為準。
Fandus Xtrm (Global) Limited 是FX GYM軟體的開發者和運營者（以下稱“ FX GYM ”或“ 我們 ”），我們非常重視用戶的隱私和個人資訊保護。您在使用我們的產品與 / 或服務時，我們可能會收集和使用您的相關資訊。我們希望通過《FX GYM隱私政策》（“本隱私政策”）向您說明我們在您使用我們的產品與 / 或服務時如何收集、使用、保存、共用和轉讓這些資訊，以及我們為您提供的訪問、更新、刪除和保護這些資訊的方式。同時，我們承諾將按業界成熟的安全標準，採取相應的安全保護措施來保護您的個人資訊。

一、我們如何收集和使用個人資訊
在您使用FX GYM軟體及服務的過程中，我們將根據合法、正當、必要的原則，收集資訊。我們收集的資訊和用途說明如下：
  1. 手機號：以手機號註冊的用戶會收集此信息，用於註冊或登錄本軟體
  2. 電郵：以電郵註冊的用戶會收集此信息，用於註冊或登錄本軟體
  3. 身高、體重、體脂、體圍等身體數據：app可以記錄體重、體脂、體圍等相關數據，如果你記錄了，我們將收集這些數據，以便做歷史數據給您展示曲線圖、計算BMI、計算飲食基礎代謝，您可以隨時刪除歷史數據，我們不會做備份
  4. 飲食記錄：當您使用飲食記錄功能時，FX GYM將記錄您的飲食數據，以便您可以隨時查看過往數據，您可以隨時刪除歷史數據，我們不會做備份

  1. 我們直接收集與使用的個人資訊
我們會按照如下方式收集您在使用服務時主動提供的，以及通過自動化手段收集您在使用功能或接受服務過程中產生的資訊：
  1. 保障FX GYM和服務的正常運行
(a) 若您創建FX GYM帳號，您可能會提供您的手機號碼等個人註冊資訊；您也可以使用第三方帳號（如電郵）登錄，此時您可能提供第三方帳號相關昵稱、頭像等資訊。
  1. 註冊、認證、登錄FX GYM和相關服務
（a）當您使用第三方帳號（如微信）登錄FX GYM。您此時將授權我們獲取您在第三方平臺註冊的公開信息(頭像、昵稱等)，並在您同意本隱私政策後將您的第三方帳號與您的FX GYM帳戶綁定，使您可以通過第三方帳號直接登錄並使用本產品和相關服務。
  1. 其他第三方分享的您的資訊
主要包括兩種情況： （a）其他用戶發佈的資訊中可能包含您的資訊。 （b）您在使用第三方合作夥伴服務時所產生或分享的資訊，當您使用其他第三方帳號登錄我們的軟體產品或服務時，我們需要核實您的身份或綁定您的帳戶資訊，經過您的授權將相關帳號關聯到我們的產品或服務中。
  1. 保障產品、服務及用戶使用安全
為幫助我們更好地瞭解FX GYM及相關服務的運行情況，以便確保運行與提供服務的安全，我們可能記錄網路日誌資訊，以及使用軟體及相關服務的頻率、崩潰數據、總體安裝、使用情況、性能數據等資訊。
     2.廣告服務優化
為了保證良好的用戶體驗，向您提供眾多免費、優質的服務，我們會接入第三方分享服務，對廣告進行統一優化，我們會收集的有關您位置的資訊。如您不想被訪問，可以向我們申請選擇關閉設備或產品/服務中的相關功能，但可能會因此影響我們向您提供相關服務。 
     3.第三方SDK接入服務所需開通的許可權
（a）我們的產品和服務可能包括第三方的產品和服務，以及第三方網站的鏈接。當您使用這些產品或服務時，第三方也可能收集您的資訊，具體手機資訊以第三方隱私政策為准。您可以通過本政策第十二條“第三方SDK接入資訊”進行詳細瞭解。
（b）對第三方SDK的接入，我們僅會出於合法、正當、必要、特定、明確的目的共用您的個人資訊，並只會共用提供服務所必要的個人資訊，對於其他不必要資訊我們會採取匿名化處理。同時，我們還會與其簽署嚴格的保密協定，要求其按照我們的說明、本隱私政策以及其他任何相關保密和安全措施來處理。
（c）收集、使用個人資訊目的變更的處理
（d）依法豁免征得同意收集和使用的個人資訊
請您理解，在下列情形中，根據法律法規及相關國家標準，我們收集和使用您的個人資訊無需征得您的授權同意：
（1）與國家安全、國防安全直接相關的；
（2）與公共安全、公共衛生、重大公共利益直接相關的；
（3）與犯罪偵查、起訴、審判和判決執行等直接相關的；
（4）出於維護個人資訊主體或其他個人的生命、財產等重大合法權益但又很難得到本人同意的；
（5）所收集的您的個人資訊是您自行向社會公眾公開的；
（6）從合法公開披露的資訊中收集的您的個人資訊的，如合法的新聞報導、政府資訊公開等管道；
（7）涉及商業秘密的；
（8）為合法的新聞報導所必需的；
（9）學術研究機構基於公共利益開展統計或學術研究所必要，且對外提供學術研究或描述的結果時，對結果中所包含的個人資訊進行去標識化處理的；
（10）法律法規規定的其他情形。
請您注意，目前FX GYM不會主動從我們外的第三方獲取您的個人資訊。如未來為業務發展需要從第三方間接獲取您個人資訊，我們會在獲取前向您明示您個人資訊的來源、類型及使用範圍，如FX GYM開展業務需進行的個人資訊處理活動超出您原本向第三方提供個人資訊時的授權同意範圍，我們將在處理您的該等個人資訊前，征得您的明示同意；此外，我們也將會嚴格遵守相關法律法規的規定，並要求第三方保障其提供的資訊的合法性。
（a）自啟動和關聯啟動說明：
（b）為確保本應用處於關閉或後臺運行狀態下可正常收到客戶端推送的廣播消息，本應用須使用自啟動能力，將存在一定頻率通過系統發送廣播喚醒本應用自啟動或關聯啟動行為，是因為實現功能及服務所必要的。
三、我們如何存儲個人資訊
（1）資訊存儲的地點
我們依照法律法規的規定，將在運營過程中收集和產生的您的個人資訊存儲於香港伺服器。
（2）存儲期限
我們僅在為提供FX GYM及服務之目的所必需的期間內保留您的個人資訊，包括您發佈的內容等資訊、評論、點贊等資訊，在您未撤回、刪除或未註銷帳號期間，我們會保留相關資訊。超出必要期限後，我們將對您的個人資訊進行刪除處理，但法律法規另有規定的除外。
（3）數據跨境轉移
無數據跨境轉移，所有數據均存儲在香港伺服器。
四、我們如何共用、轉讓、公開披露個人資訊
（1）共用
我們不會與關聯公司（即廣州雲科資訊科技有限公司母公司及投資子公司，下同）以外的任何公司、組織和個人分享您的個人資訊， 但以下情況除外：
a.在獲取明確同意的情況下共用：獲得您的明確同意後，我們會與其他方共用您的個人資訊。
b.我們可能會根據法律法規規定，或按政府主管部門的強制性要求， 對外共用您的個人資訊。
c.與關聯公司共用：我們只會共用必要的個人資訊，且受本隱私政策中所聲明目的的約束。如要改變個人資訊的處理目的，將再次徵求您的授權同意。
d.與授權合作夥伴共用：僅為實現本政策中聲明的目的，我們的某些服務將由授權合作夥伴提供。我們可能會與合作夥伴共用您的某些個人資訊，以提供更好的客戶服務和用戶體驗。我們的合作夥伴無權將共用的個人資訊用於任何其他用途。
目前，我們的授權合作夥伴包括以下幾大類型：

（3）公開披露的個人資訊
請您理解，在下列情形中，根據法律法規及國家標準，我們共用、轉讓、公開披露您的個人資訊無需征得您的授權同意：
（a）獲得您明確同意後；
（b）與國家安全、國防安全直接相關的；
（c）與公共安全、公共衛生、重大公共利益直接相關的；
（d）與犯罪偵查、起訴、審判和判決執行等直接相關的；
（e）出於維護您或其他個人的生命、財產等重大合法權益但又很難得到您的同意的；
（f）您自行向社會公眾公開的個人資訊；
（g）從合法公開披露的資訊中收集個人資訊的，如合法的新聞報導、政府資訊公開等管道。
五、我們如何保護個人資訊安全
（1）我們非常重視您個人資訊的安全，將努力採取合理的安全措施（包括技術方面和管理方面）來保護您的個人資訊，防止您提供的個人資訊被不當使用或未經授權的情況下被訪問、公開披露、使用、修改、損壞、丟失或洩漏。
（2）我們會使用加密技術、匿名化處理等合理可行的手段保護您的個人資訊，並使用安全保護機制防止您的個人資訊遭到惡意攻擊。
（3）我們會建立專門的安全部門、安全管理制度、數據安全流程保障您的個人資訊安全。我們採取嚴格的數據使用和訪問制度，確保只有授權人員才可訪問您的個人 資訊，並適時對數據和技術進行安全審計。
（4）互聯網環境並非百分之百安全，我們將盡力確保或擔保您發送給我們的任何資訊的安全性。如果我們的物理、技術、或管理防護設施遭到破壞，導致資訊被非授權訪問、公開披露、篡改、或毀壞，導致您的合法權益受損，我們將承擔相應的法律責任。同時，我們強烈建議您採取積極措施保護個人資訊的安全，包括但不限於使用複雜密碼、定期修改密碼、不將自己的帳號密碼等個人資訊透露給他人。
（5）在不幸發生個人資訊安全事件後，我們將按照法律法規的要求，及時向您告知：安全事件的基本情況和可能的影響、我們已採取或將要採取的處置措施、您可自主防範和降低風險的建議、對您的補救措施等。我們將及時將事件相關情況以郵件、信函、電話、推送通知等方式告知您，難以逐一告知個人資訊主體時，我們會採取合理、有效的方式發佈公告。
同時，我們還將按照監管部門要求，主動上報個人資訊安全事件的處置情況。
六、您的權利
按照香港相關的法律、法規、標準，以及其他國家、地區的通行做法，我們非常重視您對個人資訊的管理，並盡全力保護您對於您個人資訊的訪問、修改（更新或更正）、刪除以及改變授權同意的權利，以使您有能力保障您的隱私和安全。
（1）訪問、更正、刪除您的個人資訊
您可以通過以下方式管理您的資訊：
一般情況下，出於安全性和身份識別的考慮，您可能無法自主修改註冊時提交的某些初始註冊資訊；如您確有必要修改該類資訊，請您通過電子郵件至info@fandusxtrm.com聯繫我們的個人資訊保護專員申請更改，我們將儘快審核所涉問題，並由專人驗證您的用戶身份後及時予以回復。
（2）停止運營向您告知權利
如我們停止運營，我們將及時停止收集您個人資訊的活動，將停止運營的通知以逐一通過電子郵件、信函、電話、推送通知、公告等形式通知您，並對所持有的您的個人資訊進行刪除或匿名化處理。
七、未成年人使用條款
1.若您是未滿18周歲的未成年人，在使用“FX GYM”軟體及相關服務前，應在您的父母或其他監護人監護、指導下共同閱讀並同意本隱私政策。
2.我們根據國家相關法律法規的規定保護未成年人的個人資訊，只會在法律允許、父母或其他監護人明確同意或保護未成年人所必要的情況下收集、使用、共用或披露未成年人的個人資訊；如果我們發現在未事先獲得可證實的父母同意的情況下收隼了未成年人的個人資訊，則會設法儘快刪除相關資訊。
3.若您是未成年人的監護人，當您對您所監護的未成年人的個人資訊有相關疑問時，請通過本隱私政策公示的聯繫方式與我們聯繫。
八、隱私政策的修訂和通知
（1）為了給您提供更好的服務，FX GYM軟體及相關服務將不時更新與變化，我們會適時對本隱私政策進行修訂，該等修訂構成本隱私政策的一部分並具有等同於本隱私政策的效力。但未經您明確同意，我們不會削減您依據當前生效的本隱私政策所應享受的權利。
（2）本隱私政策更新後，我們會在FX GYM應用程式客戶端和官方網站發出更新版本，並在更新後的條款生效前以適當的方式提醒您更新的內容，以便您及時瞭解本隱私政策的最新版本。如您繼續使用我們的服務，表示同意接受修訂後的本政策的內容，但是如果更新的內容需要採集內容、獲取您通訊錄、聯繫方式、地理位置等個人敏感資訊，仍會再次以顯著方式徵求您的同意。
（3）對於重大變更，我們還會提供更為顯著的通知（我們會通過包括但不限於郵件、短信、私信或在流覽頁面做特別提示等方式，說明隱私政策的具體變更內容）。
本隱私政策所指的重大變更包括但不限於：
a.我們的服務模式發生重大變化。如處理個人資訊的目的、處理的個人資訊的類型、個人資訊的使用方式等；
b.我們在所有權結構、組織架構等方面發生重大變化。如業務調整、破產並購等引起的所有變更等；
c.個人資訊共用、轉讓或公開披露的主要對象發生變化；
d.您參與個人資訊處理方面的權利及其行使方式發生重大變化；
e.我們負責處理個人資訊安全的責任部門、聯絡方式及投訴管道發生變化時。
九、適用範圍
本隱私權政策適用於由Fandus Xtrm (Global) Limited及其關聯方提供的所有服務，包括FX GYM客戶端、網站等，不適用於有單獨的隱私權政策且未納入本隱私權政策的第三方產品或服務。
您使用這些第三方服務（包括您向這些第三方提供的任何個人資訊），將受這些第三方的服務條款及隱私政策約束（而非本隱私政策），具體規定請您仔細閱讀第三方的條款。請您妥善保護自己的個人資訊，僅在必要的情況下向第三方提供。
本隱私政策中所述的FX GYM及相關服務有可能會根據您所使用的手機型號、系統版本、軟體應用程式版本等因素而有所不同。最終的產品和服務以您所使用的FX GYM軟體及相關服務為准。
十、其他
（1）本“隱私政策”中的標題僅為方便及閱讀而設，並不影響本《隱私政策》中任何規定的含義或解釋。
（2）本“隱私政策”相關詞語釋義：
FX GYM軟體及相關服務是指公司及其關聯方通過合法擁有並運營的、標注名稱為FX GYM的客戶端應用程式以及FX GYM官方網站，向您提供的產品與服務
關聯方是指，指一方現在或將來控制、受控制或與其處於共同控制下的任何公司、機構以及上述公司或機構的法定代表人。“控制”是指直接或間接地擁有影響所提及公司管理的能力，無論是通過所有權、有投票權的股份、合同或其他被依法認定的方式。
個人資訊是指，以電子或者其他方式記錄的能夠單獨或者與其他資訊結合識別特定自然人身份或者反映特定自然人活動情況的各種資訊，包括個人身份資訊（姓名、出生日期、身份證件號碼，包括身份證、軍官證、護照、駕駛證）、面部特徵、地址、聯繫電話、通信錄、網路身份識別資訊（包括帳號名、帳號昵稱、郵箱地址以及與前述有關的密碼與密碼保護問題和答案）；財產資訊、交易資訊、個人上網記錄（網路流覽記錄、點擊記錄等）、個人常用設備資訊（包括硬體型號、設備MAC地址、操作系統類型、軟體列表唯一設備識別碼等在內的描述個人常用終端設備基本情況的資訊）、個人位置資訊等。
個人敏感資訊是指，一旦洩露、非法提供或濫用可能危害人身和財產安全，極易導致個人名譽、身心健康受到損害或歧視性待遇等的個人資訊。本隱私政策中的個人敏感資訊包括：包括個人身份資訊（身份證件號碼，包括身份證、軍官證、護照、駕駛證）、面部識別特徵；財產資訊、交易資訊；網路身份識別資訊（包括帳號名、帳號昵稱、郵箱地址以及與前述有關的密碼與密碼保護問題和答案）；其他資訊（包括通信錄、個人電話號碼、行程資訊、精准定位資訊）。
去標識化是指，通過對個人資訊的技術處理，使其在不借助額外資訊的情況下，無法識別個人資訊主體的過程。
匿名化是指，通過對個人資訊的技術處理，使得個人資訊主體無法被識別，且處理後的資訊不能被復原的過程。

Body data such as height, weight, body fat, and body circumference: The app can record relevant data such as weight, body fat, and body circumference. If you record it, we will collect these data in order to make historical data and show you curves.
